$9.7M Award to 37 Year Old Bronx Woman Who Fell Down Decrepit Stairs
Yesterday, a Bronx Supreme Court Justice upheld $9.7M of a $13M jury verdict awarded to a 37 year old woman who fell down a flight of stairs shattering her leg resulting in multiple surgeries. Worse, the plaintiff developed an extremely painful nerve disorder called complex regional pain syndrome, in addition to traumatic arthritis of the ankle joint. The plaintiff was visiting a friend at 2265 Davidson Avenue in the Bronx and fell down a flight of stairs when one of the steps cracked off. The evidence showed that five of the eleven steps had been replaced within a year of the accident. Incredibly, the building superintendent admitted he knew all the steps were worn out but he was waiting for that particular step to break before replacing or repairing it. The jury told the building owner/property manager what they thought of the superintendent's policy. Kromah v 2265 Davidson Realty, Bronx Supreme Court, Index No. 303791/13
