Bronx Judge Rules Wheelchair Bound Plaintiff Has The Right To Ambulate To The Witness Box In Front Of The Jury
In a lengthy decision dated December 24, 2023, Kings County Supreme Court Justice Aaron D. Maslow denied the defendant's motion to pre-seat a wheelchair bound plaintiff (pushed by an aide) in the witness box. The defendant-motorist, while making a right turn, was claimed to have carelessly struck the pedestrian/plaintiff who was crossing the roadway in the crosswalk. The Court found that it was proper for the jury to observe the plaintiff wheeled to the witness box by an aide during both the liability and damages phases of the trial. The Court held: " Forced to be seated beforehand in the witness box while other witnesses can walk unassisted shames a person, and compels the person to feel degraded in the eyes of the law."
