Brothers of 61 Year Old Killed Crossing Street With Right of Way in Cross Walk-Settled for $1.5 Million
On August 10, 2016 the Kings County Surrogate, Margarita Lopez Torres approved a $1.5 million dollar settlement of a wrongful death claim against the City of New York brought by the two brothers of a 61 year old man killed while crossing the intersection of Broadway and Hooper Street. Tragically, this pedestrian was in the crosswalk - with the light in his favor, when a NYC police van made a left turn onto Broadway striking the pedestrian who died later that same day.
The City claimed the pedestrian was careless in crossing the street; however, the evidence against the City was strong. A surveillance camera captured at least some of the collision and a witness was ready to testify that the driver of the police van was using a cell phone at the time of the collision.
