Dentist Can't Avoid Liability By Hiding Behind a PC
A New York City Civil Court Judge has denied a dentist's motion to dismiss a patient's claim of fraudulent representation as to his dental experience. The dentist claimed that the patient failed to sue his professional corporation and that he could not be held personally liable. The Court gently explained to this dentist that a shareholder in a professional corporation remains "personally and fully liable...for any negligent act or misconduct committed by him or by any person under his direct supervision and control."
