Kings County Jury Bounces Injured Gym Patron Who Fractured Wrist And Blamed Trainer
On December 20, 2023, a Kings County jury found in favor of an Equinox Fitness facility and its trainer who were sued by a patron who fractured his wrist when he fell during an exercise class. Surgery was necessary to stabilize the fractures with an open reduction and internal fixation. The plaintiff was attending a class and engaged in box jumps where you rapidly jump up and off stackable risers or platforms. The plaintiff's theory of liability was that the stackable platforms were not properly weighted and subject to slippage when participants jumped onto them with a lateral force. There was indeed a battle of expert engineers testifying for each side. interestingly, the defense argued that the plaintiff had previously used the box jump successfully and assumed the risk that he could not balance himself when attempting to jump on top of 10 stacked risers.
