Legal Malpractice Insurers Predict Another Wave of Claims
Ames & Gough's survey of leading legal malpractice insurers found some had experienced double digit increases in claims in 2019 and expect another surge in 2020. According to a spokesperson at Ames & Gough: "The sustained shutdown of the US economy this year due to the Covid-19 pandemic may trigger yet another wave of legal malpractice claims, similar to what we saw in the aftermath of the 2008 recession." It is believed that a lack of communication and documentation by attorneys is at the root of the problem. Ames & Gough also reported that conflicts of interest continue as the most frequent alleged legal malpractice claim.
