Manhattan Law Firm Accused Of Stealing $1M From Insurance Company Settlement Funds

On September 20, 2019, First Mercury Insurance Company filed a lawsuit against the Manhattan based law firm of D'Amato & Lynch claiming that it unethically deposited a $1 million dollar settlement check into its operating account rather than a trust or escrow account. Worse yet, First Mercury claims that it asked D'Amato & Lynch to return the settlement funds and they refused. According to First Mercury's complaint, D'Amato & Lynch are in financial distress and have been sued by their landlord. Causes of action include fraud, conversion and a violation of Judiciary Law Section 487 which allows treble damages and attorney fees. Sup. Ct. New York County, Index No. 159185/2019
