New York County Jury Award of $1.3M Upheld for Bimalleolar (Ankle) Fracture
On October 13, 2022, the Appellate Division, First Department upheld a Manhattan jury verdict of $1,315,000 awarded to a NYC Taxi and Limousine Commission employee against the NYC Transit Authority for injuries suffered when he was struck by an articulated bus. The plaintiff's injuries included a bimalleolar (ankle) fracture and multiple fractures in his hand. The ankle fracture required surgical fixation and a second surgery due to a shift in the hardware. The breakdown in damages was $740,000 for past pain and suffering; $315,000 for future pain and suffering; and, $260,000 for past lost earnings. Deguilme v NYC Transit Authority, 2022 WL 7177908
