NYC Housing Authority Found To Have Violated Scaffold Law
On November 14, 2019, an appellate court covering Bronx County cases, held that a construction worker had demonstrated entitlement to a pre-trial ruling that the NYC Housing Authority failed to properly protect him from a fall off a 10 foot high sidewalk bridge. This means that a jury trial will only decide how much the plaintiff should be compensated for his injuries. The construction worker was helping to assemble the sidewalk bridge when an unsecured plank of wood struck him and knocked him off the bridge. According to the construction worker the NYC Housing Authority failed to provide side barriers for the sidewalk bridge and neglected to provide him with a safety harness to avoid "gravity-related harm" as required by Labor Law Section 240 (1).
