Queens County Jury Awards $5,730,000 to Family of Patient Brain Damaged During Surgery
I obtained a verdict of $5,730,000 against an anesthesiologist and hospital for the wrongful death of a 56 year old elevator mechanic who suffered a brain injury due to low blood flow (hypoperfusion) during surgery to place a feeding tube in his stomach. The patient had been hospitalized for one week at a major NYC hospital recovering from a lateral medullary stroke that prevented him from swallowing or walking - though he could move all extremities and communicate. During the first week, the patient received his nutrition thru a naso-gastric tube that goes thru the nose and into the stomach.The physician's at the hospital recommended that the patient undergo surgery to place a feeding tube into his stomach so that a rehab facility would accept him for transfer. During the G-tube procedure, the patient's blood pressure dropped to dangerously low levels on 2 separate occasions depriving the brain of oxygen and necessitating that the procedure be aborted.
The jury found that the attending anesthesiologist departed from accepted medical practices because she failed to promptly treat the drop in blood pressure during the first hypotensive event. The jury found that this departure was a substantial contributing factor in the patient's death one year later--and the cause of his paralysis, bedsores, inability to communicate and dependence on a ventilator. For the next 12 months the patient remained bed ridden and could only blink, nod and mouth words in response to simple questions.
