Brain Damaged Baby - Settlement of $1,750,000
On April 10, 2019 New York City Health & Hospitals Corporation agreed to settle a claim alleging a failure to emergently deliver a baby via cesarean section for $1,750,000. The baby was delivered vaginally and was born suffering from periventricular leukomalacia (a type of brain injury) and global developmental delays. It was also claimed that the Bronx City hospital failed to properly monitor the mother's labor and failed to promptly diagnose and treat fetal distress. Perhaps explaining the low settlement amount, the hospital had a defense that the baby suffered from Angelman Syndrome, a rare genetic disorder, which is unrelated to any event during labor.
