Hospital Ordered To Disclose Audit Trail/Metadata

Yesterday, the appellate court covering Brooklyn reversed Judge Gloria M. Dabiri and compelled Wyckoff Heights Medical Center to disclose the audit trail of a patient's hospital chart. The patient sued alleging malpractice in his post operative care leading to a below knee amputation. The audit trail or metadata will tell you "who accessed the records, when and where the records were accessed, and changes made to the records". Hospitals are required by state and federal law to maintain an audit trail. Vargas v Lee, 2019 WL 1271883
