Malpractice Caused Wrongful Death-Queens County Jury Awards $1.3M For 18 Days of Suffering
On March 22, 2023, an appellate court covering Queens County appeals rejected a hospital's claim that a jury verdict of $1,300,000 was excessive to compensate the Estate of a man who endured pain and suffering for his final 18 days after the malpractice occurred. The Court held that there was a reasonable basis for such an award because: "by discharging the decedent to a rehabilitation center without ever accurately diagnosing the condition that caused him to be admitted to the hospital, and that this conduct proximately caused the decedent's injuries by diminishing his chance of a better outcome and increasing his pain and suffering."
